Agreement to Terms

By accessing or using Tidal Wave Training's services, website, or facilities, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Membership and Class Bookings

Membership Terms:

• All memberships and class packages are non-transferable
• Membership fees are billed according to your selected plan
• Cancellation policies vary by membership type and must be submitted in writing
• Class bookings must be made in advance through our booking system
• Late cancellations (less than 12 hours before class) may result in loss of class credit

Health and Safety

Assumption of Risk:

• You acknowledge that physical exercise involves inherent risks
• You certify that you are in good physical condition and have no medical conditions that would prevent safe participation
• You agree to consult with a physician before beginning any fitness program
• You will immediately inform instructors of any injuries, discomfort, or medical conditions
• You agree to follow all safety instructions and facility rules

Liability Waiver

By using our services, you agree to release, waive, discharge, and covenant not to sue Tidal Wave Training, its owners, instructors, employees, and agents from any and all liability, claims, demands, or causes of action arising from your participation in classes or use of facilities, including but not limited to personal injury, property damage, or wrongful death.

Facility Rules

All members and guests must:

• Arrive on time for scheduled classes
• Wear appropriate athletic attire and footwear
• Respect instructors, staff, and other members
• Clean and return equipment after use
• Refrain from disruptive behavior
• Follow all posted safety guidelines

Payment Terms

Billing and Payments:

• All fees must be paid in advance unless otherwise agreed
• We accept major credit cards and electronic payments
• Failed payments may result in suspension of membership privileges
• Refunds are provided only in accordance with our refund policy
• Prices are subject to change with 30 days' notice

Intellectual Property

All content on our website and in our facilities, including text, graphics, logos, images, and workout programs, is the property of Tidal Wave Training and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Photography and Media

By participating in our classes and events, you consent to being photographed or recorded for promotional purposes. If you do not wish to be included in promotional materials, please notify us in writing.

Termination

We reserve the right to terminate or suspend your membership immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms of Service, violation of facility rules, or behavior that endangers the safety or well-being of others.

Limitation of Liability

To the maximum extent permitted by law, Tidal Wave Training shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. Material changes will be notified to members via email or posted notice. Your continued use of our services after any changes constitutes acceptance of the new terms.
